Why Apple Won
Apple won because Apple represents a modern digital religion. They sold a biblical-style story to the jury.
Apple delivered the 10 Commandments of Innovation and Consumer-friendly design to the jury, and they ate it up like most Americans eat up religious stories. Stories move most people far more than facts and figures.
Apple has been brilliant at being a religious-like force in American culture. And religious constructs infect the brain quickly and readily. We all like to believe things. And once we believe things, we personally invest in our beliefs.
Then there's nativism. Samsung's very brand name sounds Korean -- it doesn't sound part of the American Religion, nevertheless the Apple digital religion. This I believe worked against Samsung more than will ever be reported. The Media doesn't really like talking about American Nativsm, but it's there.
Of course, Apple also won because Samsung was far too eager to copy-and-paste "the best of" tracks from Apple's playbook. It's probably a cultural thing more than anything else, yet it is what it is.
I, for one, am not looking forward to a non-tap-to-zoom world outside of the Apple ecosystem.
