Can Att force customer to buy data plan for unlock smart phone?

Today I received this e-mail from AT&T. We bought an unlocked iPhone through an Apple Store, and just used it on WIFI without the data plan. AT&T insisted that we have to buy data plan in order to use the phone, even though we don't need data plan. I tried to talk to AT&T, but I don't have any luck with them. Can AT&T force costumer to buy service that they don't need? The whole reason that we bought an unlocked iPhone is to avoid data plan fee.
