You’re 100% right until the “isolated terrorism” part. We aren’t even close to getting the complete picture on this. Calling it isolated is a jump to a conclusion.

Le’ts resist bringing race or shade of skin in to it. One can be a victim and a victimizer. He’ll get a needle in the arm for the victimizing part of his actions. Ultimately there is likely some cleric in Degestan responsible for convincing him to do this. Doesn’t excuse the bomber of the crimes though. We’re all smart enough to look at the big picture and not lose sight of justice for the bombing victims.

Now you’re backtracking and redefining your stance? And you’re accusing me of strawman?
A. We don’t even know the situation in it’s entirety.
B. Being under the influence of a terrorist organization(if this is the case) and acting in their proxy after infiltrating the US is the definition of insurgency.
C. If you’re not a citizen and you conduct B. you’re not privy to 6th amendment protection. I might point out that you’re in fact not privy to protection under the Geneva Convention on Warfare.
We both are going to have to admit we don’t know the full situation. What I’m willing to say is his younger brother gets a trial and Miranda no matter what he did(see 6th amend.). I’m also confident in saying the older brother, who has been reported as NOT a US citzen, doesn’t get the protection his little brother does. He’s obviously dead but for sake of argument the law and constitution is the basis of my decision and again, you’re applying emotion, law and constitutional protections be damned.

From the info we have the younger guy may in fact be a victim of his brother’s control and influence and that in isolation is a tragedy. However…he’s ultimately responsible for his own actions and he’ll likely be executed or be in prison for life.
I certainly share your opinion about his likely being on some level a victim. Still got to fry for this though.

Most if not all of what you’ve said are baseless allegations about Guantanamo. You do realize that the ACLU has a dozen or more lawyers there ready to pounce on even a rumor of mistreatment or torture. Guantanamo is likely the most scrutinized detention center on the planet. To address waterboarding in particular, it has been used on only two inmates during this entire war(one being KSM). You’re pretty transparent as well with your textbook criticism sandwich,(Positive preface/baseless negative accusations/complement before conclusions). Please try harder in the future.

He very well may have. But those who argue it are going to have to go to court and get his citizenship revoked. It’s pointless since he’s in custody. He’d have to have a trial in absentia to remove his citizenship. He’s clearly not in absentia since he’s in custody(a trial in absentia now would be a 6th amend. violation). The sentence for treason is life in prison or execution. He’s currently going to face several first degree murder charges.

This is a common misconception. Congress would have to revoke citizenship first and the process isn’t simple. This is often overlooked or not discussed because the government has executed a US citizen overseas in Yemen with drones(not on a battlefield). You might have heard about a senator conducting a filibuster over this.

I’m with you on this. There are murder charges that are sufficient to convict and execute him. The expansion of “WMD” is similar to the use of “Hate crime”. If we allow these to expand they’ll be potentially easier to apply to lesser crimes and arbitrarily increase the severity of sentencing depending on the politics or whims of a prosecutor/judge.

I don’t think you’re going to find a constitutional or legal argument to your opinion. Maybe it violates YOUR values. Consult an astronomer and he’ll break the news to you that our universe is heliocentric, even if you think you’re the center of it.

I believe your heart is in the right place but you’re wrong. If a non citizen gets inside our borders and operates as an enemy combatant he is deserved fewer protections. Keep in mind he is in essence conducting himself in the same way as a hostile invading force. To subscribe to your logic would mean in the event of foreign enemy invasion we’d have our military protecting the borders and the police lined up behind them to Mirandize any enemies wounded or captured on our side of the border. Rethink your position. I’m not calling you stupid. You just haven’t thought it through and applied Logos or Ethos. Your current reaction is an emotional based one.

The guy is scum but he is a US citizen. He gets his 6th amendment rights. His deceased brother is not a US citizen. If he was captured alive an argument could be made for sending him to Guantanamo as an enemy combatant.
