So again. No precedent in the law, or in Article III of the Constitution, can compel Motorola, or even a private citizen for that matter to follow judicial orders that fall outside the boundary of the US. That’s I’ve been saying. This judge can issue this order all day long. And Moto can ignore it as well. The judge can only penalize Moto with regard to their American based operations (which would likely be overturned on appeal for the very reasons I’ve cited).
We continue to be looking at different sides of the coin. Go back & examine some of the atrociously dumb rules the EU tried to force on Microsoft. I was in college then & we studied those decisions in depth. Including the EUs attempts to compel Microsoft to comply globally. They couldn’t do that anymore than a circuit judge in Seattle can force Motorola to not have a ban enacted in Germany where they won an injunction. That’s all I’ve said.

Interesting also that you continue to talk about precedent. We are talking past each other still. I’m referring to the fact… FACT… That judicial decisions in the US cannot be enforced elsewhere. That’s all I’ve said from the beginning. Too bad fundamental understanding isn’t readily available for you.

I’m of the opinion that most of the policies you outlined were probably the directives of Sanjay Jha. He seemed something of a controlling personality when I viewed any speeches or presentations he gave. Kind of like a Steve Jobs lite if you will (though I can’t see the appeal considering the worthless personality & ethics of that guy). But I digress. I expect Dennis Woodside to be much more personable & quite possibly change the culture at Moto. Both would be positive developments.

Still trying? The 9th circuit being the largest is the most relevant why? Oh that’s right it means exactly nothing. It doesn’t change the fact that more of those rulings are overturned than any other circuit. Motorola could in fact probably appeal this to the US District Court in DC (the place where the “9th Circus” is frequently mocked & ridiculed & debunked) & more than likely get this ruling thrown out.
And to help you out a little, you obviously need the education. Common Law is NOT litigated law nor is it part of the legal code itself. It must be legislated into the legal code BY THE CONGRESS. I get this is hard for you to understand. But eventually you will catch on. I learned all of this in Broadcast Law while in college so please quit trying to impress me with your lack of knowledge. Or just keep reading Wikipedia & tyring to boast some more. It’s working. Really it is.

I think the official statement from HP was wrong. I also saw one from Google regarding this.
HP: “We are well aware of this & have full contingency plans in place. Everything is normal as always. Nothing to see here please move along. Move along now.”

Saying Motorola can’t seek injunctive relief elsewhere is in effect saying the German courts orders are null & void. That is the point. But please continue to argue the exact same thing & lay an attempted insult.

sigh No I didn’t check the entire civil code. I didn’t need to. You see the Library of Congress, thru Thomas.gov, provides its very own search engine! Wow imagine the shock of discovering that. Quite simple really to go there & enter the search terms for what are looking for. By the way you’ll find over 1800 entries dealing with judicial orders & enforcement. Amazingly, a similar conclusion is reached by virtually every entry; Judicial orders in the US carry NO enforcement mechanism in a foreign land. It is up to the Congress (they do exist still I think) to come to a treatise with a foreign gov’t to allow such co-enforcement to occur. That is what I said from the beginning in so many words that was kept short for conversational brevity. That didn’t occur to you? As for the French court… Totally at their discretion. We have an extradition treaty w/ France but no civil enforcement treaty.
And finally, the 9th circuit? Your kidding right? Found yourself a good source there. You are also aware that among ALL federal circuit courts the 9th is the most overturned there is right? I used Google & got that little nugget. Thx for the tip.

A most excellent point indeed. Florian Mueller has been exp[ossed as what he is, & he has admitted by the way. He’s nothing more than a paid shill for Oracle & Micrsoft. There is nothing wrong with that in reality. But it’s much like NBC & MSNBC news media here in the US. It must be viewed thru a prizm of bias toward it’s preferred side of the issue. Save the comments of FOX blah blah blah. They ALL are guilty of this nonsense.

As a Microsoft & Android user I have to say this particular case has me quite befuddled. The larger point that really got me going is an American judge forcing an injunction in a foreign jurisdiction. To which NO sitting American judge at any lvl has the authority! I looked it up in the US Penal Code thru the Library of Congress (didn’t bother pulling a link anybody can go find it if they so desire). I understand patent law, though for the most part I don’t agree with it with regards to software patents. I also understand the nature of the game that Microsoft plays by approaching others with their hand extended saying; “Hey why not just license that & all is well & forgiven.” That of course stands in stark contrast to the Apple approach where they simply want a competitor removed from the market. I still find it hard to fathom, however, how an American judge can enforce such a ruling as this. Even though Motorola is an American based company, as are all the players in this drama. At the weaters edge US law comes to a swift halt.

As Apple tells it, the company rode in on a white horse to save the ebook industry, saying that the iBookstore “benefitted consumers” and “brought competition where none existed.”
I believe in the Steve Jobs bible… Oops book… He discussed with publishers the need to raise prices & that Apple could make that happen? Sorry Apple. You got caught with your hand in the cookie jar trying to take more than your share.
Save the comments about Apple hater & troll etc etc etc. If a company does wrong or illegal business they deserve just punishment regardless of who they are.

Set top boxes are part of Motorola Mobility. They were not part of Motorola Solutions even before the split.

So for assumptions sake;
Google keeps Moto intact (slimmer & speaker of course), keeps all those patents (don’t even start the nonsense they are all worthless, reality is we all know better), & makes a Nexus device by Moto…
Question: Will any of that make the update process any better or take a little control out of the wireless carriers hands to improve user experiences? Probably not.

Mistake #1 friend was using Wikipedia as your source. Do that all day & it means nothing. Try the Library of Congress thru USA.gov & you can follow it to the US Constitution or actual laws on the books, as well as case law & attempts to limit free speech in the US. Here’s a big hint… It has failed almost every time.

I think I did cite Anandtech for it’s technical article that showed what somebody else pointed out above. I cited Consumer Reports for real world testing that showed just what I said. No I didn’t provide links. I don’t have the time or inclination to do homework for everybody. They can Google the articles. Or Bing it if they’re so inclined. Or maybe they can iSearch it… No wait

And all that metal & glass in the iPhone had done wonders for signal quality & connectivity hasn’t it?
And before the isheep launch their attacks against me, your precious Apple phone has been proven time & again to have weak signal compared to the most basic Android phone. Anandtech & Consumer Reports are easily credible sources for that info… among many others. And that is not opinion but tested & proven fact.

Please provide links to all of these ‘consumer surveys’ that show fragmentation as a big issue. And no Molly Wood & a bunch of tech bloggers opinions do not count. I mean actual random man or woman on the street surveys, done by a group of unbiased types with no axe to grind, & show everyone here all the panic in the streets over Android fragmentation.
Speaking personally, I can’t tell you how often I will see random strangers in public using an Android phone, & vociferously complaining that such & such app doesn’t work & if only their particular phone had this version or that one. Yep… I see it all the time.

Indeed there a quite a few rich dictators in Central Africa. Now if you are talking about the more affluent western & southern African nations, much more wealth & better standards of living. Just a quick scan of Apple’s annual report doesn’t show much business in Central Africa.
