It is an unreleased product but these folks had their hands on with the console and the controller so I think it is fair that they give their first impressions and early concerns.
Besides, David Pierce said the console was nice and they were wowed by the event. Bryan Bishop was “excited knowing that Redmond is continuing to push forward on this particular front — both with hardware and software” Tom’s piece about Xbox One and Windows is simply a legitimate concern as there are real concerns brought up by the developers so I just see Tom as reporting such.
You have to remember too that Tom gave Windows 8 an 8.8 score (even higher than the user score) so I really don’t understand this whole notion of The Verge hating Microsoft.

I can imagine people choosing Spotify over What.cd because of seeding difficulties. Getting good ratio is tough. Not to mention having a lot of buffer.
Nintendo solved their emulator and ROM problems with the Wii U (for now) and 3DS. I don’t think Nintendo wants to go to a territory where people can easily leak the Nintendo apks so other phones and tablets can play their games for free.
