Because LG, Huaweii, Asus, Acer, HP, Pantech, Motorola and Dell all did/are doing so great with Android today?

No, that would not have happened. Sony has fantastic brand recognition. They’ve got beautiful phones, millions of Playstation fans, and people still fondly remember their walkmans.
What has that done for them? Nothing. Nokia would go the same route. Outstanding hardware isn’t enough. The One X was beautifully designed and it bombed. Samsungs are built like shit and they are selling by the truckload. Samsung phones have gobs of gimmicks, that’s why they sell. That and marketing. Nokia’s marketing hasn’t save the Lumia brand, and Android is a word barely uttered in commercials. You know the last ad I heard the word Android mentioned in? MetroPCS touting their “Samsung Infusalicious Desire 4G Buzzword” running “the hot new Android operating system”.
No normal people know what “Android” means. They know brand names that are pushed at them through a television screen. “Samsung” “Droid” “One” not “Android 4.2.2 Jelly Bean”. No Samsung commercials say “running a modified Android build with a skin called touchwiz”. Android is not a selling point, “Galaxy”, “Instagram”, “4G” are selling points.
Nokia has fantastic hardware. So does Sony. So does HTC. Sony is doing piss poor in sales. HTC is losing money and is watching executives leave right and left. Nokia would have died before they ever made a profit because of how fast they were declining; they needed Microsoft’s cash. Going Android would’ve just meant less Nokia phones ever being made. Android is doing so well because they have the low end market. Windows Phone runs way better on low end hardware than Android does and Nokia’s not selling low end Windows Phones either; they’re selling Ashas.
So what does that leave us? Nokia pumping out a 1080p, quad core phone. It’s doubtful they’d have even that, considering how those weren’t the norm in 2011. So, presuming they somehow didn’t die off before 2013, they’d launch a flagship phone that would probably not have a 41 mp camera on it, due to the lack of funds they wouldn’t be able to afford to put into figuring out how to make the one on Symbian work on Android. Nokia would be grasping at straws, in its death throws because there would be no reason to buy a Nokia over a Samsung. Nokia doesn’t have the resources to upgrade their skin for every Android release like Samsung can. And face it, in order to differentiate themselves they’d have to come up with a skin. And remind me, what companies have made a non-laggy, non-ugly skin on their first try? That’s right, no one. Nokia would be no different. Did you see their concepts for Windows Phone? They were hideous. Now imagine if they had to go with that for Android. It’d be suicide.
Nokia wouldn’t have made it today if they’d gone with Android. They are struggling now, but they have nearly the entirety of the Windows Phone playing field to themselves, and that is their differentiation. Not some laggy, crappy skin. Not just “it’s Nokia! You remember us, right guys?” But an entire OS basically dominated.
Android took four years to reach significant marketshare and only had to compete with iOS and a dying blackberry. Windows Phone has been out for less than three years and is fighting Android and iOS, and is steadily gaining marketshare in basically every country except the US. That’s a lot brighter outlook than HTC, Sony, LG, Huaweii, Acer, Asus, Dell, HP or anyone besides Samsung had or has for Android on phones or tablets.

That was awful. I never use Apple and love my Windows Phone but those comparisons were terrible.

Microsoft has not addressed how game rentals will work yet.

Your edit caught onto his point, which is the same one I have. Make a required internet check upon install to make sure you’re the only one with a license, then install it to the digital library. If the internet connection isn’t working, pop in the disc to play until it comes back on. This keeps people happy instead of pissed off because they can’t use their Xbox on a group camp out, and keeps them from getting frustrated if their broadband is finicky. Plus, it prevents duplicating games by requiring a check on install. If you give it to a friend and they try to install it, it lets you know that you’re not the only one with that game, and that you need to contact the previous owner, and can give you their gamer tag if they’ve said that’s okay in the settings.

Second edit, it still takes tethering, which I’m not going to drop another 40 bucks for just because my internet’s down.

Edit: Saw the article saying you can ping from mobile. Still, camping where you don’t have signal with friends and want to play Xbox should still be possible.

What they really should do just to appease the few that it will effect is let them game discs work as authentication and forego the DRM check if you have the disc in the One. Get a connection to install when you first play then use the disc if you don’t have internet connection afterwards.
