Judge Lucy Koh has pushed several times for Apple and Samsung to settle their differences outside of the courtroom, and this morning she asked that the CEOs of both companies meet one last time before the jury begins deliberations. "I don't mean to waste their time," she said, but noted that she sees peril for both sides— even outside of the possibility of a hung jury.

If Apple and Samsung's primary goals have been to raise awareness of their intellectual property, Koh said, "mission accomplished." Both Apple and Samsung agreed to the request. She made the comments after urging both sides to narrow their cases as well, hoping to reduce the number of claims in order to make things easier on the jury. Earlier this week, Koh agreed to a Samsung request to remove three different phones from the case since Apple hadn't shown they were ever sold by Samsung within the United States.
